Article 70 - Official Oaths
7.

All other officers elected or appointed to any office
of trust or profit under the Constitution and laws of this
State, including the mayors or other chief magistrates of
municipal corporations, shall take and subscribe the said
oath [in the City of Baltimore before the clerk of the
Superior Court, and in the several counties] before the
clerk of the circuit court or before one of the sworn
deputies of such clerks.

12.

The [clerk of the Superior Court and] clerks of the
circuit courts (who shall be entitled to a fee of ten cents
for administering the aforesaid oath, to be paid by the
party), shall report to the Secretary of State, at least
once a month, the names and offices of all officers who have
taken and subscribed the same before them, respectively,
which reports shall be carefully preserved by the said
Secretary of State; and he shall be competent to certify the
character and qualification of officers equally with the
aforesaid clerks.

Article 73B - Pensions

1.

The following words and phrases as used in this
article, unless a different meaning is plainly required by
the context, shall have the following meanings:

(3) "Employee" shall mean any regular classified or
unclassified officer or employee of the State for whom
compensation is provided for by the State appropriation, or
whose compensation is paid from State funds, including all
regular employees of the State Highway Administration,
whether classified or unclassified and whether paid on an
annual, daily or hourly basis, and shall expressly include
those engaged in work on the maintenance of county roads
under the supervision of the State Highway Administration.
The term "employee" shall include any appointed or elected
employee of the State, and any clerk of any court and
register of wills, and shall include the Sheriff of
Baltimore City and the employees of his office. It shall
exclude any person who is a member of or eligible to
membership in the Teachers' Retirement System of the State
of Maryland or of the State Police Pension Fund or any judge
of the circuit courts, [Supreme Bench of Baltimore City,]
Court of Appeals of Maryland, Court of Special Appeals, and
District Courts or any commissioner of the Workmen's
Compensation Commission, and any class of employees whose
compensation is only partly paid by the State or who are
