9-203. AUTHORITY OF SECRETARY; REPORTS TO ASSISTANT
SECRETARY.

(A)   IN GENERAL.

(1)  THE DIRECTOR EXERCISES THE POWERS, DUTIES,
AND RESPONSIBILITIES OF OFFICE SUBJECT TO THE AUTHORITY OF
THE SECRETARY.

(2)  THE DIRECTOR SHALL REPORT TO THE ASSISTANT
SECRETARY FOR MENTAL HEALTH AND ADDICTIONS.

(B)  POWERS AND DUTIES.

THE SECRETARY MAY EXERCISE ANY POWER OR PERFORM ANY
DUTY OF THE ADMINISTRATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of the sixth sentence of former Article 43B, §
lA(a) and the first paragraph of § 5.

In subsection (b) of this section, the former
phrase "in his discretion" is deleted as
unnecessary in light of the word "may".

Also in subsection (b) of this section, the
former reference to the law from which the
Administration derives its authority is deleted
as unnecessary.

Assistant Secretary for Mental Health and
Addictions and specific authority over this
Administration, see § 2-103(c) of this article.
