Medical Assistance Program - Reimbursement
FOR the purpose of requiring the Department of Health and
Mental Hygiene to reimburse exclude certain providers
at a certain rate for certain depreciation expenses
taken during participation in the Maryland Medical
Assistance Program; defining certain term; exempting
the providers from repaying the depreciation
reimbursement allowance to this State; and generally
relating to depreciation expenses under the Maryland
Medical Assistance Program.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
(as enacted by Chapter____ (H.B./S.B.___) of the Acts of
the General Assembly of Maryland of 1982) read(s) as
follows:
Article - Health -General
15-127 15-122.1.
(A)(1) IN THIS SECTION, "PARTICIPATING PROVIDER"
MEANS A FACILITY THAT PARTICIPATES IN THE PROGRAM:
(I) VOLUNTARILY;
(II) INVOLUNTARILY; OR
(III) THROUGH THE SALE OR LEASE OF ITS
FACILITIES.
(2)(A) IN THIS SECTION, "PARTICIPATING PROVIDER"
INCLUDES MEANS MEANS ANY FACILITY THAT PARTICIPATES IN THE
PROGRAM AND IS:
AND OR
(I) (1) A SKILLED NURSING FACILITY;
(II) (2) A COMPREHENSIVE CARE FACILITY;
(III) (3) AN INTERMEDIATE CARE FACILITY
THAT PARTICIPATES IN THE MEDICAL ASSISTANCE PROGRAM.
