(d) (1) Upon failure of a municipality or person to
comply with an order of the Secretary of Health and Mental
Hygiene to extend or alter a sewerage system or refuse
disposal works as provided in [Article 43, § 392 of the
Code] TITLE 9 OF THE HEALTH - ENVIRONMENTAL ARTICLE, the
Secretary of Health and Mental Hygiene shall direct the
service to make alterations or extensions to the systems or
works, or install a new system or works as the Secretary of
Health and Mental Hygiene deems necessary to correct the
improper conditions.
(3) Funds to pay the service for costs incurred
as a result of actions taken under this subsection may be
raised as provided in [Article 43, § 395 of the Code] TITLE
9 OF THE HEALTH - ENVIRONMENTAL ARTICLE. If the order was
against a person, the service shall charge the person with
the cost of making the necessary improvements to comply with
the directive of the Secretary of Health and Mental Hygiene.
If the person fails to pay within 60 days, the cost becomes
a lien against the property served if it is recorded and
indexed as provided in this subtitle, and the matter shall
be referred to the Attorney General for collection.

(f) "Low-level nuclear waste" means any substance or
material designated as low-level nuclear waste under [§
689B(c) of Article 43 of this Code] § 7-201(J) OF THE HEALTH
- ENVIRONMENTAL ARTICLE.

(b) (1) On receipt of the application for a
certificate the Board shall forward a copy of that
application to the Department of Health and Mental Hygiene.
The Department of Health and Mental Hygiene shall consider
the application for a certificate as an application for the
facility permit that is required under [Article 43 of the
Annotated Code] THE HEALTH - ENVIRONMENTAL ARTICLE.
(2) On receipt of any application for a facility
permit that is required under [Article 43 of the Annotated
Code] THE HEALTH - ENVIRONMENTAL ARTICLE, the Department of
Health and Mental Hygiene shall forward a copy of the
facility permit application to the Board.

(b) (2) To this purpose, the Department of Health and
Mental Hygiene routinely shall furnish the Service with
copies of relevant information and data, filed with the
Department under the provisions of [Article 43] THE HEALTH -
ENVIRONMENTAL ARTICLE that are applicable to the generation,
transport, and disposal of hazardous waste.
