Ch. 770
(a) In any case where a patient is in need of corneal
tissue for a transplant, the Chief Medical Examiner, the
deputy [chief] CHIEF MEDICAL EXAMINER, or an assistant
medical examiner may provide the cornea upon the request of
the Medical Eye Bank of Maryland, Incorporated under the
following conditions:
(1) [A] THE MEDICAL EXAMINER HAS CHARGE OF A
decedent who may provide a suitable cornea for the
transplant [is under his jurisdiction and an];
(2) AN autopsy will be required [in accordance
with Article 22 of the Code];
(3) [(2)] No objection by the next of kin is
known by the medical examiner; and
(4) [(3) The] REMOVAL OF THE cornea for
transplant will not interfere with the subsequent course of
an investigation or autopsy or alter the [post mortem]
POSTMORTEM facial appearance.
(b) [Neither the] THE Chief Medical Examiner, the
deputy [chief] CHIEF MEDICAL EXAMINER, an assistant medical
examiner, [nor] AND the Medical Eye Bank of Maryland,
Incorporated [is] ARE NOT liable for civil action if the
next of kin subsequently contends that [his] authorization
OF THAT KIN was required.

(k) "Mental facility" means any place providing a
clinic, hospital, day residential or other programs, public
or private, other than a veterans' hospital, which purports
to or does provide treatment for persons suffering from
mental disorders as defined in [Article 59 § 3 (f)] §
10-101(F) OR § 12-101(F) OF THE HEALTH - GENERAL ARTICLE,
mental retardation as defined in [Article 59A § 3 (i),
chronic alcoholism as defined in Article 2C § 103 (b) and] §
7-101(H) OF THE HEALTH - GENERAL ARTICLE, OR drug addiction
as defined in [Article 43B § 3 (f)] § 9-101{H) OF THE HEALTH
- GENERAL ARTICLE OR FOR CHRONIC ALCOHOLICS AS DEFINED IN §
8-101(C) OF THE HEALTH - GENERAL ARTICLE.

(b) This section does not:
(1) Limit the right of a school of [anatomy,]
medicine[,] or dentistry to use and dispose of a dead human
body or its parts;
