(ii) This authority to direct
modifications in location may be exercised to effect
reasonable changes in the location of the major project by
the [Montgomery] county council [or the Prince George's
County governing body, depending on] OF the county in which
the major project is located [,] when the major project is
first approved as a part of the WSSC Capital Improvements
Program.
(3) After approval of the major project in the
WSSC Capital Improvements Program, the [Montgomery] county
council [or the Prince George's County governing body,
depending on] OF the county in which the major project is
located [,] may make further modifications only:
(i) If the modifications do not result in
substantial net additional costs or expenses to the WSSC; or
(ii) If the county directing the
modification reimburses the WSSC for substantial net
additional costs or expenses.
7-106.
(a) The WSSC shall:
[(i)] (1) Review the WSSC Capital Improvements
Program;
[(ii)] (2) Revise the program as required by the final
action of the [Montgomery] county [council or the Prince
George's County governing body] COUNCILS; and
[(iii)] (3) Adopt the WSSC's Capital Improvements
Program before the beginning of the first fiscal year of
that program.
(c) (2) The amendment:
(iii) Requires final action by the [Montgomery] county
council [or the Prince George's County governing body] OF
EACH AFFECTED COUNTY.
(f)(1) Unless the County Councils have approved the
extension, the WSSC:
(f)(1) Unless the [Montgomery] county [council]
COUNCILS [and the Prince George's County governing body]
have approved the extension, the WSSC:
(i) May not extend or approve construction
of a sewer of any size or capacity to serve property in
either county beyond the area which has been approved for
service in a WSSC capital improvements program AND THE 10
YEAR WATER AND SEWER PLAN; or
