Ch. 767

[18-2] 18-102. Leaving dead animals or fecal matter
unburied.

(A)  [It shall be unlawful for any] A person[, firm or
corporation within] IN the sanitary district [created by
chapter 122 of the Acts of 1918] or [upon] ON any watershed
from which the [commission] WSSC gets its water supply[,
whether within or without the district, to] MAY NOT leave
unburied for a longer period than [twenty-four] 24 hours any
dead animal [or animals] or fecal matter.

(B)  [, and the commission may in addition to the
penalty hereinafter provided after the expiration of the
time,] AFTER 24 HOURS, THE WSSC MAY bury the animal or fecal
matter and charge the cost [thereof] OF THE BURIAL to the
owner or the person [upon] ON whose property the [same is]
ANIMAL OR FECAL MATTER WAS found.

[18-3. Violation of two preceding sections.

Any violation of the provisions of sections 18-1 and
18-3 is hereby declared to be a misdemeanor and shall be
punishable before any justice of the peace or the circuit
court of the county in which such offense; is committed, and
any person adjudged guilty thereof shall be subject to a
fine not exceeding $100 or thirty days in the county jail or
both in the discretion of the court.]

COMMITTEE NOTE: Former Article 67, § 18-3 now appears
in § 18-104 of this title.

[18-4. Sanitary district not comprehended within Article
HE of state Constitution.

The general assembly of Maryland hereby finds,
determines and declares that the term "municipal
Corporation" in Article HE of the Constitution of Maryland
does not embrace or include the Washington Suburban Sanitary
District which was incorporation by chapter 122 of the laws
of the General Assembly of Maryland of 1918, that the
Washington Suburban Sanitary District cannot be classified
in any group of municipal corporations as required by
Article HE, and that Article 11E therefore has no
application to the Washington Suburban Sanitary District.]

COMMITTEE NOTE: Former Article 67, § 18-4, which
defined "municipal corporation", now appears in §
1-101 of this article.

[18-5] 18-103. Exemption from Forestry Act fees.

THE [Washington Suburban Sanitary Commission] WSSC is
[hereby exempted] EXEMPT from the payment of any fees or
charges under the [state] STATE Forestry Act, [sections] §
5-403(b) and (c) of the Natural Resources Article [of the
Annotated Code].
