The penalty provisions that had appeared in
former Article 67, §§ 12-2(e) and 12-3(f) now
appear in Title 18 of this article.
Former Article 67, Title 12 is repealed in its
entirety. Except for the provisions of §§ 12-101
through 12-106 of this title, Article 40A of the
Code already provides the ethical controls that
were in former Article 67, Title 12.
SUBTITLE 2. FINANCIAL DISCLOSURE.
COMMITTEE NOTE: Section 4 of this Act provides that "if
PG/MC 1-1982 is enacted, §§ 12-201 through
12-203, inclusive, of this Act are null and void
without the necessity of further action by the
General Assembly, and Commissioners and employees
of the WSSC are subject to the financial
disclosure provisions of Article 40A of the Code.
If §§ 12-201 through 12-203, inclusive, of this
Act are null and void, the sections may not be
printed in the Annotated Code."
12-201. Pecuniary or property interest.
IF A COMMISSIONER OF THE WSSC IS PRESENT AT A MEETING
AT WHICH A MATTER IS DISCUSSED IN WHICH THE COMMISSIONER HAS
A DIRECT OR INDIRECT PECUNIARY OR PROPERTY INTEREST, THE
COMMISSIONER SHALL DISCLOSE THE INTEREST AT THE MEETING.

12-202. Disclosure -- Montgomery County.
(A) (1) IN MONTGOMERY COUNTY, ON OR BEFORE JUNE 1 OF
EACH YEAR, EACH COMMISSIONER SHALL DISCLOSE IN WRITING TO
THE COUNTY EXECUTIVE AND THE COUNTY COUNCIL ALL FINANCIAL
INTERESTS IN PROPERTY HOLDINGS IN THIS STATE AND IN THE
GREATER WASHINGTON METROPOLITAN AREA OF:
(I) THE COMMISSIONER; AND
(II) THE COMMISSIONER'S SPOUSE, FATHER,
MOTHER, BROTHER, SISTER, OR CHILD.
(2) THE COUNTY EXECUTIVE SHALL DISCLOSE TO THE
PUBLIC ALL INFORMATION RECEIVED.
(B) THE COUNTY EXECUTIVE OR THE COUNTY COUNCIL MAY
REQUIRE SUBSTANTIATION AND ADDITIONAL INFORMATION.
