(5) IF THE WSSC HAS MADE EXPENDITURES TO THIRD
PARTIES FOR SERVICES OR PROPERTY AS PART OF ANY APPROVED
MAJOR PROJECT AND THAT MAJOR PROJECT IS SUBSEQUENTLY
MODIFIED OR REMOVED BY EITHER COUNTY SO THAT THE SERVICES OR
PROPERTY ARE NO LONGER NECESSARY, THE COUNTY DIRECTING THE
MODIFICATION OR REMOVAL SHALL REIMBURSE THE WSSC FOR THE
AMOUNT OF THE EXPENDITURES.
(6) The [commission's] WSSC SHALL GIVE
MONTGOMERY COUNTY OR PRINCE GEORGE'S COUNTY ANY right,
title, and interest in any items for which reimbursement has
been made [shall be conveyed to the county governing body].
[(4)] (G) Within [five] 5 days after [its] final
action ON THE WSSC CAPITAL IMPROVEMENTS PROGRAM, [annually,
with respect to the commission's capital improvements
program submitted to it, each county governing body] EACH
COUNTY COUNCIL shall transmit to the [commission] WSSC
notification of [such] FINAL action, [giving] INCLUDING:
(I) [the] THE details of any changes or
modifications; and
(II) [showing fulfillment of any of the
herein above mentioned specified] INDICATIONS OF COMPLIANCE
WITH ANY SPECIFIED conditions [which] OF THIS TITLE THAT may
be. applicable to [such] THE FINAL action.
7-106. Amendments.
[(d) (1) The commission shall review, and where
required by the county governing body's final action on the
program, revise the same and then prior to the commencement
of the first fiscal year of the six-year program, adopt the
capital improvements program.]
(A) THE WSSC SHALL:
(I) REVIEW THE WSSC CAPITAL IMPROVEMENTS
PROGRAM;
(II) REVISE THE PROGRAM AS REQUIRED BY THE
FINAL ACTION OF THE COUNTY COUNCILS MONTGOMERY COUNTY
COUNCIL OR THE PRINCE GEORGE'S COUNTY GOVERNING BODY; AND
(III) ADOPT THE WSSC'S CAPITAL
IMPROVEMENTS PROGRAM BEFORE THE BEGINNING OF THE FIRST
FISCAL YEAR OF THAT PROGRAM.
(B) The WSSC'S capital budget [of the commission for
such succeeding] FOR THE FIRST fiscal year OF THE WSSC
CAPITAL IMPROVEMENTS PROGRAM shall [make provision] PROVIDE
for [undertaking] BEGINNING the approved MAJOR projects for
the first year of the approved [six-year] WSSC capital
improvements program.
