7-104. Submission of program.
BEFORE OCTOBER 1 OF EACH YEAR, THE WSSC SHALL PREPARE
AND SUBMIT A WSSC CAPITAL IMPROVEMENTS PROGRAM TO THE COUNTY
EXECUTIVE AND COUNTY COUNCIL OF MONTGOMERY COUNTY AND THE
COUNTY EXECUTIVE OF PRINCE GEORGE'S COUNTY.
7-105. Final action; review.
(A) (1) IN MONTGOMERY COUNTY, THE COUNTY EXECUTIVE
SHALL SUBMIT RECOMMENDATIONS AND SUGGESTED AMENDMENTS ABOUT
THE WSSC CAPITAL IMPROVEMENTS PROGRAM TO THE COUNTY COUNCIL
AS AN INTEGRAL PART OF THE COMPREHENSIVE SIX-YEAR CAPITAL
IMPROVEMENTS PROGRAM REQUIRED BY THE MONTGOMERY COUNTY
CHARTER.
(2) IN PRINCE GEORGE'S COUNTY, THE COUNTY
EXECUTIVE SHALL TRANSMIT THE WSSC CAPITAL IMPROVEMENTS
PROGRAM TO THE COUNTY COUNCIL TOGETHER WITH COMMENTS,
RECOMMENDATIONS, AND SUGGESTED AMENDMENTS.
COMMITTEE NOTE: Subsection (a)(2) of this section is a
nonsubstantive addition to Article 67 to correct
an apparent erroneous omission as to Prince
George's County and to reflect normal operating
procedure in Prince George's County.
[(c) Each county governing body shall finally act
upon, by way of approval, disapproval or modification, as
more particularly hereinafter set forth, the commission's
six-year capital improvements program. Such approvals or
modifications may include as a part the designation of a
water or sewer main as being of controlled or limited access
for service to designated areas within that county.]
(B) (1) BEFORE [The] final action on [each annual
commission's] THE WSSC'S [six-year] capital improvements
program [shall occur only after] IS TAKEN, public hearings
SHALL BE HELD on the program.
(2) [which] THE PUBLIC HEARINGS may be conducted
in conjunction with public hearings on the [county governing
body's own and other agencies' six-year] 6 YEAR programs or
capital budgets OF MONTGOMERY COUNTY, PRINCE GEORGE'S
COUNTY, OR OTHER AGENCIES.
