by any state, county or municipal authority except fire
departments and/or rescue squads recognized by the county
commissioners and/or the county council of the respective
counties and/or maintained and operated by a municipal
authority within either of the counties, notwithstanding any
law or ordinance to the contrary, which fire departments
and/or rescue squads shall also be exempt from sewer usage
charges. The provisions of this section shall not be
construed as authority to repudiate any existing contracts
between the Washington Suburban Sanitary Commission and any
municipality located within the Washington Suburban Sanitary
District without the consent of the municipality.]
(B)(1) THIS SUBSECTION DOES NOT INVALIDATE, WITHOUT
THE CONSENT OF A MUNICIPALITY LOCATED IN THE SANITARY
DISTRICT, ANY CONTRACT BETWEEN THE WSSC AND THE
MUNICIPALITY.
(2) EXCEPT AS PROVIDED IN PARAGRAPH (3) OF THIS
SUBSECTION, THE WSSC SHALL CHARGE AND COLLECT ITS USUAL
WATER RATE, INCLUDING A READY TO SERVE CHARGE, FOR ALL WATER
USED BY THIS STATE, MONTGOMERY COUNTY, PRINCE GEORGE'S
COUNTY, OR ANY MUNICIPAL AUTHORITY IN MONTGOMERY COUNTY OR
PRINCE GEORGE'S COUNTY.
(3) NOTWITHSTANDING ANY LAW OR ORDINANCE TO THE
CONTRARY, A FIRE DEPARTMENT OR RESCUE SQUAD THAT IS
RECOGNIZED BY MONTGOMERY COUNTY OR PRINCE GEORGE'S COUNTY OR
THAT IS MAINTAINED AND OPERATED BY A MUNICIPAL AUTHORITY IN
MONTGOMERY COUNTY OR PRINCE GEORGE'S COUNTY IS EXEMPT FROM
WATER RATES, METER SERVICE CHARGES, AND SEWER USAGE CHARGES.
[6-6.] 6-106. Ad valorem tax -- Generally; transfer of
facilities to Montgomery County.
(A) (1) THIS SECTION DOES NOT REPEAL, MODIFY, OR
RESTRICT THE PROVISIONS OF § 3-206 OF THIS ARTICLE. THE
WSSC'S POWERS AND AUTHORITIES SPECIFIED IN THAT SECTION ARE
ADDITIONAL AND SUPPLEMENTAL TO THOSE IN THIS SECTION.
(2) For that portion of the City of Takoma Park
[lying within] IN Montgomery County, the [commission] WSSC
shall request the [county council of] Montgomery County
COUNCIL to levy an additional ad valorem tax at a rate [to
be] certified [to the county council] BY THE WSSC TO BE THE
AMOUNT necessary to produce annually the sum required to pay
the principal and interest for the current year on the
outstanding bonds authorized by [section 4-11] § 4-111 of
this article.
[The provisions of this section shall not in any way
repeal, modify or restrict the provisions of section 3-11 of
this article, and the commission's powers and authorities
specified in that section are additional and supplemental to
those herein set out.]
