Article 67, § 5-1(1), which is transferred to §

5-ibi(f).

[(j)](B)(1) IN THIS SUBSECTION "COST OF
CONSTRUCTION" INCLUDES THE COST OF CONNECTING A WATER AND
SEWER LINE TO THE WSSC SYSTEM.

(2)  [Where] IF an applicant applies for water or
sewer lines in an area in which the [commission] WSSC
determines THAT it is NOT economically [not] feasible to
serve unless the applicant makes a substantial contribution
to the cost of construction of [such] THE water and sewer
lines, [including the cost of connecting them with the
commission's system] the [commission] WSSC may classify THE
applicant's property together with other adjacent or
adjoining properties that could be readily served from the
construction required by THE applicant as a "remote area".

(3)  [and upon] UPON the approval of [such] THE
application, [and] the payment of the contribution, AND THE
LEVYING OF THE REQUIRED FRONT FOOT BENEFIT CHARGE, [it] THE
WSSC may construct [such] water or sewer lines as are
desired by applicant [levying the usual front foot benefit
charge as provided by law].

(4)  The [commission] WSSC may contract with the
applicant at the time of [such] THE contribution to refund
part or all of [such] THE contribution from any front foot
benefit charges levied against property on lines
subsequently constructed by the [commission] WSSC and served
through the lines of the applicant[,] within [such] THE
"remote area".

(5)  THE WSSC SHALL DETERMINE THE [The]
proportion to be refunded and the maximum time of repayment,
not exceeding [ten (10)] 10 years[, to be determined by the
commission].

(C) WHEN THE WSSC ACQUIRES AN EXISTING SYSTEM, OTHER
THAN A MUNICIPAL SYSTEM, THE WSSC MAY LEVY A FRONT FOOT
ASSESSMENT LESS THAN THE UNIFORM FRONT FOOT ASSESSMENT
LEVIED IN THE SANITARY DISTRICT IF:

(1)  THE CONSTRUCTION COST OF THE SYSTEM HAS BEEN
ADDED IN WHOLE OR IN PART TO THE PURCHASE OF LAND THAT ABUTS
ON THE SYSTEM; AND

(2)  THE ADDITION OF THE CONSTRUCTION COSTS IS A
FACTOR IN THE COST OF THE SYSTEM TO THE WSSC.

COMMITTEE NOTE: Subsection (b) of this section is
transferred from former Article 67, § 5-l(e).
