EXCEPT AS OTHERWISE PROVIDED, §§ 3-201 THROUGH 3-207 OF
THIS SUBTITLE APPLY TO:

(1) PRINCE GEORGE'S COUNTY, EXCEPT THE CITY OF
BOWIE; AND

(2) THE PORTION OF THE CITY OF TAKOMA PARK IN
MONTGOMERY COUNTY.

[3-7.] 3-202. Authority of WSSC generally.

(A)  IN THE SANITARY DISTRICT AND IN ACCORDANCE WITH
THE WSSC'S CAPITAL IMPROVEMENTS PROGRAM, THE [The Washington
Suburban Sanitary Commission] WSSC [is hereby authorized to]
MAY plan, design, construct, maintain, and operate a system
for the control and disposition of surface waters[, in
accordance with the capital improvements program of the
commission, within the limits of the Washington Suburban
Sanitary District,].

(B)  [and for this purpose, the commission is given all
of the power and authority to] THE WSSC MAY implement the
WSSC'S capital improvements program, including the right to
condemn[, heretofore given it by law] UNDER § 1-202 OF THIS
ARTICLE, [in the construction and operation of its water and
sewer system,] and [the right and authority to] MAY
negotiate AND MAKE CONTRACTS with any public agency [and to
make contracts with the agency], including the government
[of the United States] or any bureau or department
[thereof;] OF THE UNITED STATES, [provided that except as
otherwise provided herein, the above provisions shall not
apply in Montgomery County, with the exception of that
portion of the City of Takoma Park now situated in
Montgomery County or to those portions of the City of Bowie
over which the Washington Suburban Sanitary Commission had
jurisdiction prior to July 1, 1978, with respect to storm
and surface water drainage.]

[3-7.1.] 3-203. Individual floodproofing.

(a) (1) If the [Commission] WSSC determines as part of
a general stormwater management project that incidental
floodproofing for some individual properties is the most
sound alternative from [economical] ECONOMIC, environmental,
and engineering points of view to correct a particular
drainage or flooding problem, the [Commission] WSSC may
expend funds for individual floodproofing facilities on
private property [in the Prince George's County portion of
the sanitary district and in that portion of the City of
Takoma Park in Montgomery County].

(2) The WSSC [expenditure of funds under this
section] may [be] EXPEND FUNDS UNDER THIS SECTION by [the
commission]:
