(D) (1) [provided, however, that land] LAND used for
cemetery purposes may not be condemned [until and] unless
the [commission] WSSC [shall have first adopted] ADOPTS a
resolution, on the affirmative vote of a majority of the
[commission] WSSC members from the county [wherein] WHERE
[such] THE cemetery land is located, [declaring] THAT
DECLARES that it is necessary for the public health and
safety to acquire the [same] CEMETERY LAND, or an easement
[therein] IN THE CEMETERY LAND, immediately by
condemnation[, and, in that event,].

(2)  HOWEVER, land used for cemetery purposes,
either public or private, or an easement [therein] IN THE
LAND may be condemned [provided] IF the land or easement
sought to be acquired by the [commission] WSSC is for the
purpose of the installation of sewer lines, storm drainage
lines, or water lines, which lines shall be constructed
below the surface of the earth and enclosed[; and further
provided that the].

(3)  THE land or easement to be acquired [shall]
MAY not disturb any existing grave, grave marker or
monument, or any grave site the title to which has been
transferred as a result of a bona fide sale or exchange or
in which burial rights have vested or been transferred as a
result of a bona fide sale or exchange[, and the].

(E)  THE [commission] WSSC may [likewise] condemn the
interest of any tenant, lessee, or other person having an
interest in the [land, structure, or buildings, stream bed,
waterway, water right, or watershed] PROPERTY.

1-203. Conveyance of property.

THE WSSC MAY SELL, LEASE, TRANSFER, CONVEY, AND DISPOSE
OF ANY OF ITS REAL OR PERSONAL PROPERTY THAT THE WSSC DOES
NOT CONSIDER NECESSARY FOR THE OPERATION OF WSSC WATER,
SEWERAGE, OR STORM DRAINAGE SYSTEMS ON THE TERMS AND
CONDITIONS THAT THE WSSC CONSIDERS ADVANTAGEOUS.

COMMITTEE NOTE: This section is transferred from former
Article 67, § 18-6.

[1-4,] 1-204. Capital and operating budgets.

(a) The [commission,] WSSC:

(1) [prior to] BEFORE January 15 of each year,
shall [cause to be prepared] PREPARE capital and operating
budgets for the [succeeding] NEXT fiscal year, [and the
budgets] WHICH shall be open for inspection by the public
and copies shall be made available to the public [upon] ON
request[.];
