(1)  THE MENTAL RETARDATION ADMINISTRATION;

(2)  THE MENTAL HYGIENE ADMINISTRATION; OR

(3)  THE GUARDIAN OR ANY OTHER PERSON WHO HAS A

LEGITIMATE INTEREST IN THE WELFARE OF THE INDIVIDUAL.

REVISOR'S NOTE: Subsection (a) of this section is new
language added to avoid repetition.

Subsections (b), (c), and (d) of this section are
new language derived without substantive change
from former Article 59A, § 15A.

Subsection (d) of this section is revised to
reflect the substance of former Article 59, §
17A, for clarity.

SUBTITLE 8. MISCELLANEOUS PROVISIONS.

7-801. EMPLOYEES AS LAW ENFORCEMENT OFFICERS.

THE ADMINISTRATIVE HEAD OF ANY FACILITY MAY APPOINT ANY
EMPLOYEE AS A LAW ENFORCEMENT OFFICER AND, WHILE THE
EMPLOYEE HOLDS A SPECIAL POLICE COMMISSION ISSUED BY THE
GOVERNOR, THE EMPLOYEE MAY:

(1)  RETURN A MENTALLY RETARDED INDIVIDUAL TO THE
FACILITY FROM WHICH THE INDIVIDUAL ESCAPED; AND

(2)  BE USED TO PROTECT INDIVIDUALS OR PROPERTY
AT THE FACILITY.

REVISOR'S NOTE: This section formerly appeared as
Article 59A, § 18(f).

The term "administrative head" is substituted for
"superintendent", to standardize the references
to this position. See revisor's note to §
7-204(c) of this title.

The only other changes are in style.

The provisions on special police commissions
appear in Article 41, §§ 60 through 70 of the
Code.
