LAWS OF MARYLAND

Ch. 21

(I)  WOULD BE CARED FOR PROPERLY BY THE
INDIVIDUAL OR BY A RESPONSIBLE PERSON; AND

(II)  WOULD NOT ENDANGER THE INDIVIDUAL OR
THE PERSON OR PROPERTY OF ANOTHER.

(2)  THE RESPONSIBLE OFFICIAL MAY SET THE
CONDITIONS FOR RELEASE THAT THE RESPONSIBLE OFFICIAL
CONSIDERS REASONABLE. THE CONDITIONS MAY RELATE TO:

(I)  THE DURATION OF THE RELEASE;

(II)  TREATMENT DURING RELEASE; OR

(III)  PLACEMENT UNDER SUPERVISED CARE IN
AN APPROVED FOSTER HOME, BOARDING HOME, RESIDENT EMPLOYMENT,
OR OTHER FACILITY.

(3)  A MENTALLY RETARDED INDIVIDUAL RELEASED
CONDITIONALLY IS CONSIDERED TO BE HELD BY THE FACILITY OR
VETERANS' ADMINISTRATION HOSPITAL FROM WHICH THE INDIVIDUAL
WAS RELEASED.

(D) RECORD OF DETERMINATIONS.

EACH DETERMINATION ON ANY RELEASE OF AN INDIVIDUAL,
WHETHER FULL OR CONDITIONAL, INCLUDING A SUMMARY OF THE
REASONS FOR THE DETERMINATION, SHALL BE MADE A PERMANENT
PART OF THE INDIVIDUAL'S RECORD.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59A, §§ 3(p) and 16.

In subsection (a)(1) of this section, the former
reference to the "designee" of the Director is
deleted as unnecessary in light of § 7-204(c) of
this title.

Subsection (c)(2)(iii) of this section is revised
to incorporate the substance of former Article
59A, § 3(p), which defined "placement" for
purposes of former Article 59A, since "placement"
was not used always as defined. This revision
avoids the necessity of defining "placement".
See also § 7-307 of this title.

Defined terms: "Admission" § 7-101
"Director" § 7-101 "Release" § 7-701
"Facility" § 7-101 "State facility" § 7-101
"Includes"/"including" § 1-101 "Treatment" § 7-101
"Mentally retarded individual" § 7-101

7-707. TRANSFERS -- BETWEEN FACILITIES.
