SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.

CHAPTER 699

(House Bill 1328)

AN ACT concerning

Montgomery County - Alcoholic Beverages - Possession
of Open Containers
MC 278-82

FOR the purpose of placing certain restrictions on the
possession of alcoholic beverages in open containers by
any person on public property in Montgomery County;
including Montgomery County among those counties to

which the open alcoholic beverages container law

applies, and defining a certain term. providing that in
Montgomery County it is unlawful for a person to
possess in an open container any alcoholic beverage
while on certain premises; providing that in Montgomery
County a certain authorization is required in order to
possess any alcoholic beverage in an open container;
defining a certain term; and generally relating to
possession of open containers.

BY repealing and reenacting, with amendments,

Article 2B - Alcoholic Beverages

Section 214 and 216

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 2B - Alcoholic Beverages

214.

(A) IN THIS SECTION, WITH RESPECT TO MONTGOMERY
COUNTY, THE TERM "UNLESS AUTHORIZED" MEANS THE POSSESSION
AND PRESENTATION OF A WRITTEN CONSENT BY THE OWNER OF OR THE
GOVERNMENTAL ENTITY HAVING JURISDICTION OVER THE PROPERTY.

(B) A person may not possess in an open container any
alcoholic beverage, as defined in this article, while:
