SECTION 3. AND BE IT FURTHER ENACTED, That subject to
the provisions of Section 2 above, this Act shall take
effect on July 1, 1982.

(House Bill 581)

AN ACT concerning

Estates and Trusts -
Restrictions on Right to Letters in Probate

FOR the purpose of altering the class of persons to whom
letters may not be granted by providing that under
certain circumstances, letters may be granted to a
person not a citizen of the United States but who is a
spouse of the decedent and is a permanent resident of
the United States; and clarifying language.

BY repealing and reenacting, with amendments,

Section 5-105

Annotated Code of Maryland

(1974 Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Estates and Trusts

5-105.

(a) Subject to § 5-104 of this subtitle, the register
or court may grant, letters to:

(1)  A trust company;

(2)  Any other corporation authorized by law to
be a personal representative; or

(3)  Subject to subsection (b) of this section,
any individual.
