AN ACT concerning
State Police -
Custody and Sale of Certain Personal Property
FOR the purpose of substituting the General Fund of the
State of Maryland for the obsolete State Police
Pension Fund as recipient of certain revenues and the
proceeds from the sale of certain confiscated personal
property by the Maryland State Police.
BY repealing and reenacting, with amendments,
Article 88B - State Police
Section 27(d) and (e), and 31(a)
Annotated Code of Maryland
(1979 Replacement Volume and 1981 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:
Article 88B - State Police
27.
(d) The amount received from the sale of personal
property in accordance with this section shall be
distributed in the following order of priority (1) to the
Department, in an amount equal to the expense of sale and
all expenses incurred while the personal property was in its
custody, (2) to lien holders in order of their priority, and
(3) subject to the provisions of subsection (e), [to the
pension fund existing under §§ 31-37 of this article] TO THE
GENERAL FUND OF THE STATS OF MARYLAND.
(e) At any time within three years from the date of
such sale, any person submitting satisfactory proof of his
right to the possession of such personal property shall be
paid, without interest, the amount distributed to the
[pension fund] GENERAL FUND pursuant to subsection (d) (3).
After the expiration of three years from the date of such
sale, such claims shall be absolutely barred.
