(Senate Bill 1081)

AN ACT concerning

Cecil and Kent Counties - Gunning Rigs
in the Sassafras River

FOR the purpose of prohibiting a gunning rig and certain
craft connected with a rig from being on certain
portions of the Sassafras River in Cecil and Kent
counties at certain times on a gunning day; defining
certain limits on the Sassafras River; and providing
certain penalties for violation of this Act.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Natural Resources

10-624.

(A)  IN THIS SECTION, "RIVER" MEANS THE PORTION OF THE
SASSAFRAS RIVER AND ITS TRIBUTARIES LYING EAST OF A LINE
DRAWN SOUTH FROM GROVE POINT IN CECIL COUNTY TO A POINT ON
THE NORTHERLY SHORE OF KENT COUNTY JUST EAST OF BETTERTON
AND WEST OF 75° 58' 45" OF LONGITUDE.

(B)  A GUNNING RIG OR ANY CRAFT CONNECTED WITH A RIG,
WHETHER OR NOT ANCHORED, MAY NOT BE ON THE RIVER BEFORE 3:15
A.M. LOCAL STANDARD TIME ON ANY GUNNING DAY.

(C)  IN ADDITION TO ANY PENALTY PROVIDED IN THIS TITLE,
A NATURAL RESOURCES POLICE OFFICER OR ANY OTHER LAW
ENFORCEMENT OFFICER WHO FINDS A GUNNING RIG OR ANY OTHER
CRAFT THAT VIOLATES SUBSECTION (B) OF THIS SECTION SHALL
SEIZE THE GUNNING RIG OR CRAFT AND REMOVE IT FROM THE RIVER.
ANY CRAFT SEIZED UNDER THIS SECTION MAY NOT BE RETURNED TO
THE RIVER UNTIL A COURT HAS HEARD AND DETERMINED THE CASE.
