PART II. SPECIAL PROVISIONS FOR PRIVATE GROUP HOMES.

7-414. RULES AND REGULATIONS.

(A)  IN GENERAL.

IN ADDITION TO RULES AND REGULATIONS THAT GENERALLY
RELATE TO PRIVATE FACILITIES, THE DIRECTOR SHALL ADOPT RULES
AND REGULATIONS FOR ISSUING CERTIFICATES OF APPROVAL FOR
PRIVATE GROUP HOMES.

(B)  CONTENTS.

THESE RULES AND REGULATIONS SHALL PROVIDE THAT THE
FOLLOWING FACTORS BE CONSIDERED IN DETERMINING WHETHER A
PROPOSED SITE IS SUITABLE:

(1)  THE NATURE AND CHARACTER OF THE AREA;

(2)  THE AVAILABILITY OF UTILITIES; AND

(3). THE ACCESS TO TRANSPORTATION, SHOPPING,
RECREATION, AND PUBLIC ESTABLISHMENTS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59A, § 20C(a)(l), (2), and (3) and the first
sentence of § 20(b), as that sentence related to
private group homes.

The introductory clause to this section, "{i}n
addition to rules and regulations that generally
relate to private facilities," is added to
clarify that the rules and regulations for
licensing and operating a private facility also
apply to private group homes.

The former reference to rules and regulations for
the "establishment" of private group homes is
deleted as unnecessary in light of the
requirements for issuing certificates of
approval.

The former phrase "with the approval of the
Secretary" is deleted as unnecessary in light of
§§ 7-203(a) and 2-104 of this article.
