into the waters of the State shall be prima facie evidence
of a violation of this section and be subject to the
penalties imposed herein.

(c) Violation of this section is a misdemeanor and any
person convicted thereof before a court of proper
jurisdiction is punishable by a fine of not more than
$500.00, or by imprisonment of not more than ninety (90)
days, or both.

Article 56 - Licenses

Junk Dealers AND SCRAP METAL PROCESSORS

233.

(a). The term "junk" OR "SCRAP METAL" as used in this
section shall mean all goods, articles or things consisting
in whole or in part of aluminum, babbits, brass, bronze,
copper (light and heavy), lead, low carbon, chrome, low
carbon manganese, molybdenum, Monel metal, pewter, nickel,
tin, vanadium, and zinc, and all stoves, ranges, plumbing
fixtures and supplies, electrical fixtures, or wiring, gas
fixtures or appliances, water faucets, pipes, locks, and all
used railroad equipment, farm machinery or any other like
material.

(b)  The term "resident junk dealers" OR "RESIDENT
SCRAP METAL PROCESSOR" shall mean all persons who are
residents of the State of Maryland engaged in the business
of buying or selling "junk" [as herein defined] OR "SCRAP
METAL". The term "resident junk dealer's agent" OR
"RESIDENT SCRAP METAL PROCESSOR'S AGENT shall mean every
person who buys or sells junk [as hereinafter defined] OR
SCRAP METAL for or on behalf of any resident junk dealer OR
RESIDENT SCRAP METAL PROCESSOR but shall not include any
person regularly employed upon a salary by a regularly
licensed junk dealer OR SCRAP METAL PROCESSOR in the State
of Maryland.

(c)  The term "nonresident junk dealer" [or],
"nonresident junk dealer's agent", "NONRESIDENT SCRAP METAL
PROCESSOR", OR "NONRESIDENT SCRAP METAL PROCESSOR'S AGENT"
shall include all persons and firms who or which act as junk
dealers [or], junk dealers' agents, SCRAP METAL PROCESSORS,
OR SCRAP METAL PROCESSORS' AGENTS who are nonresidents of
Maryland.

234.

(a) No person within the State of Maryland, shall
engage in the business of resident junk dealer [or],
resident junk dealer's agent, RESIDENT SCRAP METAL
PROCESSOR, OR RESIDENT SCRAP METAL PROCESSOR'S AGENT without
a license therefor, which license shall be issued as
provided in this subsection.
