Ch. 515

(B)  "ATTENDANT CARE SERVICES" MEANS PROVIDING THE
FOLLOWING SERVICES FOR THE DISABLED PERSON, WHICH ARE
CERTIFIED AS NECESSARY BY AN ATTENDING PHYSICIAN OR BY A
REGISTERED NURSE:

(1)  DRESSING;

(2)  PREPARING FOOD AND ASSISTING THE DISABLED
PERSON WITH EATING;

(3)  BATHING AND PERSONAL HYGIENE;

(4)  ASSISTING WITH ROUTINE BODILY FUNCTIONS,
INCLUDING BOWEL OR URINARY CARE;

(5)  MOVING INTO OR OUT OF OR TURNING IN BED;

(6)  LAUNDERING AND PROVIDING OTHER CLOTHING
CARE; AND

(7)  CLEANING HOUSE AND PERFORMING OTHER SERVICES
OF DAILY CARE AS REQUESTED BY THE DISABLED INDIVIDUAL AND
THE ATTENDANT CARE SERVICES DIRECTOR, INCLUDING SHOPPING AND
TRANSPORTATION.

(C)  "ELIGIBLE DISABLED INDIVIDUAL" MEANS AN INDIVIDUAL
WHO:

(1)  IS AT LEAST 18 YEARS OLD AND UNDER THE AGE
OF 65; AND

(2)  HAS A SEVERE CHRONIC OR PERMANENT PHYSICAL
DISABILITY THAT PRECLUDES OR SIGNIFICANTLY IMPAIRS THE
INDIVIDUAL'S INDEPENDENT PERFORMANCE OF ESSENTIAL ACTIVITIES
OF DAILY LIVING, SELF-CARE, OR MOBILITY.

(D)  "FINANCIAL ASSISTANCE" MEANS A PAYMENT BY THE
DEPARTMENT TO AN ELIGIBLE DISABLED INDIVIDUAL TO AID IN
SECURING ATTENDANT CARE SERVICES.

(E)  "PROGRAM" MEANS THE ATTENDANT CARE SERVICES
PROGRAM.

(A) (1) THE SECRETARY SUPERINTENDENT SHALL ESTABLISH A
PILOT PROGRAM OF FINANCIAL ASSISTANCE FOR ATTENDANT CARE
SERVICES FOR ELIGIBLE DISABLED INDIVIDUALS.

(2)  ON OR BEFORE OCTOBER 1, 1982, THE DEPARTMENT
SHALL ADOPT RULES AND REGULATIONS FOR THE OPERATION OF THE
PROGRAM.

(3)  THE SECRETARY SUPERINTENDENT SHALL DESIGNATE
AN INDIVIDUAL FROM THE DEPARTMENT TO SERVE AS DIRECTOR OF
