AN ACT concerning

Medical Assistance Program - Pharmacy Assistance
Program - Financial Eligibility

FOR the purpose of providing for certain increases in the
allowable income levels for determining financial
eligibility for the pharmacy assistance program under
the Maryland Medical Assistance Program; requiring the
Secretary of Health and Mental Hygiene to set these
increases at certain times and according to certain
rates; and generally relating to the pharmacy
assistance program under the Maryland Medical
Assistance Program.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ (H.B.. 200) of the Acts of the

General Assembly of 1982) read(s) as follows:

Article - Health - General

15-124.

(a) (1) The Department shall maintain a Maryland
Pharmacy Assistance Program for low income individuals
whose:

(i) Assets are not more than the asset
schedule of the Maryland Medical Assistance Program; and

(ii) [Gross annual income is not more than
$1,700 over the medical assistance income schedule] GROSS
ANNUAL INCOME DOES NOT EXCEED THE MEDICAL ASSISTANCE INCOME

SCHEDULE BY MORE THAN:

1. $1,700: 1. $4,600 PLUS $500 FOR
EACH INDIVIDUAL OVER ONE IN A FAMILY UNIT; AND

2. AN ANNUAL INCREASE SET BY THE
SECRETARY UNDER PARAGRAPH (2)(IV) OF THIS SUBSECTION.

(2) For the purpose of paragraph (1) of this
subsection, the Secretary shall:

(i) Define excluded assets;
