"Mentally retarded individual" § 7-101

(E)  DIRECTOR.

"DIRECTOR" MEANS THE DIRECTOR OF THE ADMINISTRATION.

Article 59A, § 3(i).

The only changes are in style.

Defined term: "Administration" § 7-101

(F)  FACILITY.

(1)  "FACILITY" MEANS ANY PUBLIC OR PRIVATE PLACE
WITH A DAY, RESIDENTIAL, OR OTHER PROGRAM, CLINIC, OR
HOSPITAL THAT PROVIDES OR PURPORTS TO PROVIDE TREATMENT FOR
MENTALLY RETARDED INDIVIDUALS.

(2)  "FACILITY" DOES NOT INCLUDE A VETERANS'
ADMINISTRATION HOSPITAL.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
59A, § 3(j).

The former phrase "including housing" is deleted
as unnecessary in light of the reference to a
"residential ... program".

Defined terms: "Includes"/"including" § 1-101
"Mentally retarded individual" § 7-101
"Treatment" § 7-101

(G)  GROUP HOME.

"GROUP HOME" MEANS A FACILITY THAT:

(1)  UNDER THE SUPERVISION OF A RESPONSIBLE
ADULT, PROVIDES A HOME FOR INDIVIDUALS WHO, BECAUSE OF
MENTAL RETARDATION, REQUIRE SPECIALIZED LIVING ARRANGEMENTS;
AND

(2)  ADMITS AT LEAST 4 BUT NOT MORE THAN 8
MENTALLY RETARDED INDIVIDUALS.

REVISOR'S NOTE: This subsection formerly appeared as
the first sentence of Article 59A, § 3(k)

The former reference to "care" is deleted as
unnecessary in light of the broad reference to
"supervision".
