(H) IF ANY FARM LABOR CONTRACTOR HAS BEEN FOUND BY THE
COMMISSIONER TO HAVE VIOLATED THE PROVISIONS OF THIS
SUBTITLE OR ANY RULE OR REGULATION OR ORDER OF THE
COMMISSIONER OR HAS BEEN FOUND BY ANY FEDERAL AGENCY OR ANY
AGENCY OF ANOTHER STATE TO HAVE VIOLATED LAWS RELATING TO
FARM LABOR CONTRACTOR REGISTRATION OR THE HOUSING,
TRANSPORTATION, OR EMPLOYMENT OF MIGRANT AGRICULTURAL
WORKERS, AND THAT ADMINISTRATIVE DETERMINATION HAS NOT BEEN
INVALIDATED BY A COURT OF LAW, THEN THE COMMISSIONER MAY
REQUIRE THE FARM LABOR CONTRACTOR TO POST A SURETY BOND OR
OTHER SECURITY, IN AN AMOUNT DEEMED ADEQUATE IN THE JUDGMENT
OF THE COMMISSIONER, TO ASSURE COMPLIANCE WITH THE LAWS AND
REGULATIONS OF THIS STATE. THE REQUIREMENTS FOR FINANCIAL
ASSURANCE AUTHORIZED BY THIS SECTION MAY BE IMPOSED BY THE
COMMISSIONER AT ANY TIME AFTER THE RECEIPT BY THE
COMMISSIONER OF A CERTIFIED RECORD OF THE VIOLATION.

80F.

(A)  ANY FARM LABOR CONTRACTOR WHO WILLFULLY VIOLATES
THIS ACT SUBTITLE MAY BE FINED NOT MORE THAN $5,000 OR
SENTENCED TO PRISON FOR A TERM NOT TO EXCEED 1 YEAR, OR
BOTH. UPON CONVICTION FOR ANY SUBSEQUENT VIOLATION OF THIS
SUBTITLE OR ANY RULE OR REGULATION PROMULGATED THEREUNDER,
THE FARM LABOR CONTRACTOR MAY BE FINED NOT MORE THAN $10,000
OR SENTENCED TO PRISON FOR A TERM NOT TO EXCEED 3 YEARS, OR
BOTH.

(B)   IT SHALL BE A VIOLATION OF THIS SUBTITLE FOR ANY
PERSON TO IMPEDE, INTIMIDATE, OR INTERFERE WITH ANY OFFICIAL
OR EMPLOYEE OF THE DEPARTMENT OF LICENSING AND REGULATION
ASSIGNED TO PERFORM AN INVESTIGATION, INSPECTION, OR OTHER
FUNCTION AUTHORIZED BY THIS SUBTITLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect January 1, 1983.

AN ACT concerning

Alcoholic Beverages - Restrictions on Retail
Dealers and Consumers in Carroll County

FOR the purpose of providing that in Carroll County a person
may drink alcoholic beverages not purchased from the
license holder in the place benefited by the license if
the license is a special or a temporary license.
