WOULD BE GROUNDS FOR SUSPENSION OR REVOCATION OF A
REGISTRATION CERTIFICATE IN THIS STATE;

(6)  HAS FAILED TO COMPLY WITH ANY OF THE
PROVISIONS OF THIS SUBTITLE OR RULE OR REGULATION OR ORDER
OF THE COMMISSIONER, OR HAS BEEN FOUND BY THE SECRETARY OF
HEALTH AND MENTAL HYGIENE TO HAVE VIOLATED THAT DEPARTMENT'S'
REGULATIONS RELATING TO REQUIREMENTS FOR HOUSING,
SANITATION, OR SAFETY FOR MIGRANT AGRICULTURAL WORKERS;

(7)  HAS KNOWINGLY GIVEN FALSE OR MISLEADING
INFORMATION CONCERNING THE TERMS OR EXISTENCE OF EMPLOYMENT
TO WORKERS WHO ARE RECRUITED OR HIRED; OR

(8)  HAS FAILED, WITHOUT JUST CAUSE, TO PERFORM
AGREEMENTS ENTERED INTO OR ARRANGEMENTS WITH AN AGRICULTURAL
EMPLOYER, AGRICULTURAL ASSOCIATION, OR MIGRANT AGRICULTURAL
WORKER.

(B)  THE COMMISSIONER SHALL NOT SUSPEND OR REVOKE A
CERTIFICATE OF REGISTRATION TO A FARM LABOR CONTRACTOR
UNLESS, UPON DUE NOTICE, AN OPPORTUNITY TO BE HEARD HAS BEEN
GIVEN TO THE FARM LABOR CONTRACTOR. HOWEVER, PENDING THE
DETERMINATION OF A HEARING, THE COMMISSIONER MAY TEMPORARILY
SUSPEND A CERTIFICATE IF, IN THE COMMISSIONER'S OPINION,
SUSPENSION IS NECESSARY TO PREVENT INJURY TO OR ABUSE OF
MIGRANT AGRICULTURAL WORKERS.

(C)  THE ADMINISTRATIVE PROCEDURE ACT APPLIES TO
PROCEEDINGS BEFORE THE COMMISSIONER UNDER THIS SUBTITLE,

(D)  TO ADMINISTER AND ENFORCE THE PROVISIONS OF THIS
SUBTITLE THE COMMISSIONER MAY:

(1)  MAKE ANY NECESSARY INVESTIGATIONS;

(2)  ENTER WITHOUT DELAY AND AT REASONABLE TIMES
ANY PLACE OF EMPLOYMENT, ANY MIGRATORY LABOR CAMP, OR
HOUSING SUPPLIED BY A FARM LABOR CONTRACTOR TO MIGRANT
AGRICULTURAL WORKERS;

(3)  ADMINISTER OATHS, CERTIFY AS TO OFFICIAL
ACTS, TAKE DEPOSITION OF WITNESSES, ISSUE SUBPOENAS, AND
COMPEL THE ATTENDANCE OF WITNESSES AND PRODUCTION OF PAPERS,
BOOKS, DOCUMENTS, RECORDS, AND TESTIMONY. IN CASE OF
FAILURE OF ANY PERSON TO COMPLY WITH A LAWFUL SUBPOENA, OR
ON THE REFUSAL OF ANY WITNESS TO PRODUCE EVIDENCE OR TO
TESTIFY TO ANY MATTER REGARDING WHICH THAT PERSON OR WITNESS
MAY BE LAWFULLY INTERROGATED, A COURT OF COMPETENT
JURISDICTION, IN THE POLITICAL SUBDIVISION IN WHICH THE
PERSON OR WITNESS RESIDES OR IS THEN PRESENT, AND UPON THE
APPLICATION OF THE COMMISSIONER, MAY COMPEL OBEDIENCE BY
PROCEEDINGS FOR CONTEMPT.
