to ensure the maximum use of any available private
financing. To qualify, a sponsor must have been denied a
loan by a private lending institution, or else have received
a commitment from a private lending institution for less
than the amount of funds necessary for the rehabilitation.
If a portion of rehabilitation is to be financed by a
private lending institution, the Department shall require
that the sponsor utilize the maximum amount of private
financing which the project can support without impairing
the feasibility of the project and, if residential, of
providing affordable housing to limited-income tenants.

(8) "Fund" means the special fund established
under § 257L[(g)] (H) .

(9) "Political subdivision" means any municipal
corporation in Maryland subject to the provisions of Article
HE of the Constitution, the Mayor and City Council of
Baltimore, and any of the twenty-three counties in Maryland.

(10) "MIGRATORY LABOR CAMP" MEANS 1 OR MORE
STRUCTURES, BUILDINGS, TENTS, BARRACKS, TRAILERS, VEHICLES,
MOBILE HOMES, CONVERTED BUILDINGS, AND UNCONVENTIONAL
ENCLOSURE OF LIVING SPACES, TOGETHER WITH THE LAND
APPERTAINING TO IT, ESTABLISHED, OPERATED, OR USED AS LIVING
QUARTERS FOR 4 OR MORE MIGRATORY WORKERS ENGAGED IN
AGRICULTURAL ACTIVITIES, INCLUDING RELATED FOOD PROCESSING.

(11) "MIGRATORY WORKER" MEANS ANY PERSON FROM
WITHIN OR OUTSIDE THE STATE WHO MOVES SEASONALLY FROM 1
PLACE TO ANOTHER FOR THE PURPOSE OF EMPLOYMENT, AND WHO IS
NOT A YEAR-ROUND EMPLOYEE, AND WHO OCCUPIES LIVING QUARTERS
OTHER THAN HIS PERMANENT HOME DURING THE PERIOD OF THIS
WORK.

(12) "MIGRATORY HOUSING FACILITIES LOAN" MEANS A
LOAN TO A QUALIFIED OWNER OF A MIGRATORY LABOR CAMP MADE FOR
THE PURPOSE OF IMPROVING THE HEALTH AND SAFETY OF MIGRATORY
WORKER HOUSING FACILITIES.

(13) "OWNER OF A MIGRATORY LABOR CAMP" MEANS ANY
INDIVIDUAL, PARTNERSHIP, CORPORATION, OR OTHER BUSINESS
ENTITY WHICH OWNS A MIGRATORY LABOR CAMP LOCATED IN THE
STATE OF MARYLAND.

(c) The Maryland Housing Rehabilitation Program is
created. EXCEPT AS OTHERWISE SPECIFICALLY PROVIDED, THE
PROVISIONS OF THIS SUBSECTION SHALL NOT APPLY TO MIGRATORY
HOUSING FACILITIES LOANS.

(1) The Department shall operate the program,
and make rehabilitation loans from the fund under the
provisions of this section.
