Ch. 379

(f)   "Person" includes any individual, organization,
trust foundation, group, association, partnership,
corporation, society, or any combination of them.

(g)   "Professional fund-raiser counsel" means any
person who for a fee under any agreement plans, conducts,
manages, carries on, advises or acts as a consultant,
whether directly or indirectly, in connection with
soliciting contributions for, or on behalf of, a charitable
organization but who does not actually solicit contributions
as a part of his services. The following persons shall not
be deemed to be a professional fund-raiser counsel by reason
of the activities listed:

(1)  An attorney who renders professional legal
advice;

(2)  An attorney, investment counselor, or banker
who advises a client or customer to contribute to a
charitable organization; and

(3)  A bona fide salaried officer or employee of
a charitable organization which maintains a permanent office
in the State.

(h) "Professional solicitor" means a person who, (1)
for a financial consideration solicits contributions for, or
on behalf of, a charitable organization, either personally
or through agents or employees specifically employed for
that purpose, or (2) who plans, conducts, manages, carries
on, advises, or acts as a consultant to a charitable
organization in connection with the solicitation of
contributions but does not qualify as professional
fund-raiser counsel. The following persons shall not be
deemed to be professional solicitors by reason of the
activities listed:

(1)  An attorney, investment counselor, or banker
who advises a client or customer to contribute to a
charitable organization, if he does not otherwise perform
the functions of a professional fund-raiser counsel or a
professional solicitor; or

(2)  A bona fide salaried officer or employee of
a charitable organization which maintains a permanent office
in the State.

(i) "Solicit" means to request, directly or
indirectly, money, credit, property, A CREDIT CARD
CONTRIBUTION AS PROVIDED BY SUBSECTION (C) OF THIS SUBTITLE,
or other financial assistance in any form on the plea or
representation that the money, credit, property, A CREDIT
CARD CONTRIBUTION AS PROVIDED BY SUBSECTION (C) OF THIS
SUBTITLE, or other financial assistance will be used for a
charitable purpose. It includes:
