the Education Article as enacted by this Act shall become
effective on January 1, 1983, and it is hereby specified
that the special effective date for Section 3-802.1 does not
affect the effective date for the repeal of Section
3-802(c)(3)(iii), which shall become effective upon the
emergency enactment of this Act.

CHAPTER 339

(House Bill 285)

AN ACT concerning

Medical Care Programs - Subrogation

FOR the purpose of providing the Department of Health and
Mental Hygiene certain subrogation rights to personal
injury protection automobile insurance benefits due an
indigent or medically indigent person; providing for
the deduction of loss of income benefits and attorney's
fees; requiring certain persons to hold the subrogated
funds for the benefit of the Department; establishing a
legal cause of action against certain persons who,
after receiving notice, violate this section; allowing
the Department to compromise its subrogated rights; and
generally relating to the Department's subrogation
rights to personal injury protection automobile
insurance benefits.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ (H.B./S.B. ____) of the Acts of

the General Assembly of 1982) read(s) as follows:

Article - Health - General

15-121.

(A) IF A PROGRAM RECIPIENT HAS A CLAIM FOR ANY
MEDICAL, HOSPITAL OR DISABILITY BENEFITS UNDER ARTICLE 48A,
SECTION 539 OF THE CODE, THE DEPARTMENT SHALL BE SUBROGATED
