subtitle "23 Disposal of Excess and Surplus
State Personal Property"

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:
Article 78A - Public Works
15.
(a) Any real or personal property of the State of
Maryland or of any board, commission, department or agency
thereof, and any legal or equitable rights, interests,
privileges or easements in, to, or over the same, may be
sold, leased, transferred, exchanged, granted or otherwise
disposed of to any person, firm, corporation, or to the
United States, or any agency thereof, or to any board,
commission, department or other agency of the State of
Maryland for a consideration adequate in the opinion of the
Board of Public Works, or to any county or municipality in
the State subject to such conditions as the Board of Public
Works may impose.
(B) If said real or personal property of the State of
Maryland, disposed of hereunder, or any legal or equitable
rights, interests, privileges or easements in, to, or over
the same is under the jurisdiction or control of any board,
commission, department or other agency of the State, the
deed, lease or other evidence of conveyance of any such
property or right or interest therein, disposed of
hereunder, shall be executed on behalf of such board,
commission, department or agency of the State, by the
highest official thereof, and by the Board of Public Works,
and if any of said real or personal property of any legal or
equitable rights, interests, privileges or easements in, to,
or over the same, disposed of hereunder, is not under the
jurisdiction or control of any particular board, commission,
department or other agency of the State, the deed, lease or
other evidence of conveyance of said property or interest
therein shall be executed by the Board of Public Works only;
provided, however, that whenever any State department,
agency or commission leases State-owned property under its
jurisdiction and control to any State employee, agent,
servant or other individual in State service for purposes of
permitting such person to maintain a residence therein, such
lease shall be executed by the department, agency or
commission having such control or jurisdiction over such
property, and, additionally, shall be approved by the Budget
