Ch. 301

AN ACT concerning

Transportation of Waste Materials - Hauler Certificates

FOR the purpose of authorizing the Secretary of Health and
Mental Hygiene to require use of certain routes,
equipment, procedures, or satisfaction of certain other
conditions by a holder of a hauler certificate; and
providing that rules and regulations of the Maryland
Environmental Service which regulate or limit the use
and operation of its projects need not be on a
temporary basis but shall not conflict with any permit
or hauler certificate issued by the Department of
Health and Mental Hygiene.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter____(H.B./S.B____) of the Acts of the

General Assembly of 1982) read(s) as follows:

Article - Health - Environmental

7-251.

A hauler certificate authorizes its holder to transport
a controlled hazardous substance while the certificate is
effective[.] AND MAY REQUIRE:

(1)  USE OF SPECIFIC ROUTES, DESIGNATED AFTER
CONSULTATION WITH THE DEPARTMENT OF TRANSPORTATION, TO A
CONTROLLED HAZARDOUS SUBSTANCE FACILITY;

(2)  USE OF CERTAIN TYPES OF VEHICLES, EQUIPMENT,
OR HANDLING PROCEDURES; AND

(3)  SATISFACTION OF OTHER CONDITIONS WHICH THE
DEPARTMENT DETERMINES TO BE REASONABLY NECESSARY TO ASSURE,
TO THE EXTENT POSSIBLE, TRANSPORTATION OF CONTROLLED
HAZARDOUS SUBSTANCES IN A SAFE AND SECURE MANNER.
