AN ACT concerning

Maryland Department of Transportation -
Annual Reports

FOR the purpose of requiring the Secretary of the Maryland
Department of Transportation to annually include
annually a certain report in the Consolidated
Transportation Program; prescribing the contents of the
report; requiring the Secretary to submit to the
General Assembly by a certain date each year a certain
report on budget amendments; prescribing the contents
of the report; and defining certain terms.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Transportation

2-103.1.

(A) FOR PURPOSES OF THIS SECTION:

(1)   "CAPITAL PROJECT" MEANS:

(I)  ANY PROJECT FOR WHICH FUNDS ARE
EXPENDED FOR CONSTRUCTION, RECONSTRUCTION, OR REHABILITATION
OF A TRANSPORTATION FACILITY BY THE DEPARTMENT OR OF A
TRANSPORTATION FACILITIES PROJECT BY THE MARYLAND
TRANSPORTATION AUTHORITY; OR

(II)  CAPITAL EQUIPMENT, AS DEFINED BY THE
SECRETARY, FOR WHICH FUNDS ARE EXPENDED FOR A TRANSPORTATION

FACILITY BY THE DEPARTMENT OR FOR A TRANSPORTATION

FACILITIES PROJECT BY THE MARYLAND TRANSPORTATION AUTHORITY;

(2)   "CONSTRUCTION PHASE" MEANS THE PHASE OF A
CAPITAL PROJECT IN WHICH THE PROJECT IS OMMITTED AND
ADVANCED FROM THE PROJECT DEVELOPMENT PHASE TO COMPLETION;

(3)   "MAJOR CAPITAL PROJECT" MEANS ANY NEW,
EXPANDED, OR SIGNIFICANTLY IMPROVED FACILITY OR SERVICE THAT
INVOLVES PLANNING, ENVIRONMENTAL STUDIES, DESIGN,
