(B) TRANSPORTING.

(1)  EXCEPT AS PROVIDED IN PARAGRAPHS (2) AND (3)
OF THIS SUBSECTION, A PERSON MAY NOT SEND, TRANSPORT, OR
PERMIT OR CAUSE TO BE SENT OR TRANSPORTED OUT OF THIS STATE
ANY BODY OR ANY PART OF A BODY THAT IS UNDER THE EXCLUSIVE
CONTROL OF THE BOARD.

(2)  THE BOARD MAY AUTHORIZE THE DISTRIBUTION OF
HUMAN SPECIMENS TO ANY OUT-OF-STATE FACILITY OF A MEDICAL
SCHOOL IN THIS STATE.

(3)  THE BOARD MAY AUTHORIZE A PHYSICIAN,
TEACHER, DEMONSTRATOR, OR INVESTIGATOR OF ANATOMY TO SEND OR
TRANSPORT HUMAN SPECIMENS OUT OF THIS STATE FOR USE AT A
SCIENTIFIC OR MEDICAL MEETING, DEMONSTRATION, OR EXHIBIT.

5-409. PENALTIES.

(A)  IN GENERAL.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $500 OR IMPRISONMENT NOT EXCEEDING 1 YEAR
OR BOTH.

(B)  PUBLIC OFFICER; OFFICER OR EMPLOYEE OF
INSTITUTION.

A PUBLIC OFFICER OR AN OFFICER OR EMPLOYEE OF ANY
INSTITUTION WHO NEGLECTS OR REFUSES TO COMPLY WITH THE
PROVISIONS OF THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $100 FOR
EACH OFFENSE.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 161.

In subsection (b) of this section, reference to
an "employee" is substituted for "person of any
institution", for clarity.

Also in subsection (b) of this section, the
former minimum penalty of a $50 fine is deleted
to conform to the statement of legislative policy
