(1978 Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 76A - Public Information

9.

(A) This subtitle shall apply to a public body when it
is exercising legislative, quasi-legislative or advisory
functions.

(B) This subtitle shall not apply to a public body
when exercising executive, judicial or quasi-judicial

functions; the Governor's executive council or its

counterpart in local government, or any committee of the
council or its counterpart.

(C) (1) NOTWITHSTANDING ANY OTHER PROVISION OF LAW,
THIS SUBTITLE APPLIES TO ANY MEETING OF A COUNTY BOARD OF
EDUCATION AT WHICH ANY OFFICER OF THAT BOARD IS ELECTED.

(2) IN ADDITION TO THE REQUIREMENTS OF THIS
SUBTITLE, ANY ELECTION OF ANY OFFICER OF A COUNTY BOARD OF

EDUCATION SHALL BE CONDUCTED BY MEANS OF AN

INDIVIDUALLY RECORDED PUBLIC VOTE.

Article - Education

4-106.

(d) Except as provided in Title 3 of this article,
each county board, at its annual meeting, shall elect a
president and a vice-president from among its members BY
MEANS OF AN INDIVIDUALLY RECORDED VOTE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
