SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ (H.B./S.B.____) of the Acts of

the General Assembly of 1982) read(s) as follows:

Article - Health - Environmental

2-401.

(A) Except as provided in § 2-402 of this subtitle,
the Department may adopt rules or regulations that require a
permit or registration before a person constructs, modifies,
operates, or uses a source that may cause or control
emissions into the air.

(B) THE DEPARTMENT MAY ADOPT RULES OR REGULATIONS THAT
REQUIRE A PERMIT OR REGISTRATION BEFORE A PERSON BURNS A
WASTE COMBUSTIBLE FLUID AS A FUEL. THE PROVISIONS OF THIS
SUBSECTION SHALL BE APPLICABLE TO ALL STATIONARY SOURCES
INCLUDING GENERATING STATIONS CONSTRUCTED AND OPERATED BY
ELECTRIC COMPANIES.
