In subsection (d)(2) of this section, the phrase
"until the tag is in the possession of the
consumer" is new language added to fill a gap in
the former law.

In subsection (d)(3) of this section, "covering"
is substituted for "bags or overwraps" for
clarity.

Also in subsection (d)(3) of this section, "tag"
is substituted for "law tag", to conform to
language used elsewhere in this subtitle.

In subsection (d)(4) of this section, the phrase
"unless true without variance" is new language
added for clarity.

11-435. PENALTIES.

(A)  VIOLATION A MISDEMEANOR.

ANY PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE
OR ANY RULE OR REGULATION ADOPTED UNDER THIS SUBTITLE, IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $250 FOR EACH OFFENSE.

(B)  SEPARATE VIOLATIONS.

ANY PERSON WHO MAKES, RENOVATES, OR SELLS A PIECE OF
BEDDING OR UPHOLSTERED FURNITURE IN VIOLATION OF ANY
PROVISION OF THIS SUBTITLE, OR ANY RULE OR REGULATION
ADOPTED UNDER THIS SUBTITLE, COMMITS A SEPARATE OFFENSE FOR
EACH PIECE MADE, RENOVATED, OR SOLD.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 67G(a).

In subsection (b) of this section, the former
references to types of transfers are deleted as
unnecessary in light of the definition of "sell"
in § 11-401 of this subtitle.

Also in subsection (b) of this section, the
former reference to "remade" is deleted as
unnecessary in light of the definition of
"renovate" in § 11-401 of this subtitle.

The former provision that authorized imprisonment
for not more than 30 days on default of the
