Former Article 43, § 107, which dealt with the
discretion of a judge in issuing an order to abate a
nuisance, is deleted as unnecessary in light of the
discretionary powers given under the Courts Article. See
Schneider v. Hawkins, 179 Md. 21, 25 (1940) as to judicial
discretion.

Former Article 43, § 113, which dealt with the
collection of final judgments, is deleted as obsolete and
unnecessary in light of the Maryland Rules of Procedure.

Former Article 43, § 114, which dealt with the payment
to the Secretary of final judgments collected by counties,
is deleted as obsolete.

Former Article 43, § 115, which provided that any
judgment or interest on a judgment paid to the Secretary
under this subtitle shall become part of the General Fund of
this State, is deleted as unnecessary.

The General Assembly may wish to consider undertaking a
substantive revision of this title. There are many problems
in this title -- e.g., archaic and obsolete provisions
that this revision could not address.

"DISTRIBUTE" INCLUDES:

(1)  OFFERING FOR SALE;

(2)  SELLING;

(3)  BARTERING; AND

(4)  GIVING AWAY.
