HARRY HUGHES, Governor

2437

Revisor's Note to this article.

10-105. INJUNCTIVE ACTIONS.

THE SECRETARY MAY BRING AN ACTION TO ENJOIN ANY PERSON
FROM COMMITTING ANY NUISANCE SUBJECT TO THIS TITLE.

REVISOR'S NOTE: This section is new language patterned
after the last half of the third clause of the
first sentence of Article 43, § 2.

The language "subject to this title" is added to
clarify the types of nuisances that a person may
be enjoined from committing under this section.

The references in Article 43, § 2 to judicial
jurisdiction are omitted as repetitive of other,
independent provisions of law.

The phrase "any person" is substituted for the
phrase "no matter by whom or what authority
committed", for brevity and clarity.

SUBTITLE 2. NUISANCE ABATEMENT.

10-201. INVESTIGATION AND NOTICE BY HEALTH OFFICERS.

(A)  INVESTIGATION.

THE HEALTH OFFICER FOR EACH COUNTY:

(1)  MAY INVESTIGATE ANY CONDITION IN THE COUNTY
THAT IS DANGEROUS TO HUMAN HEALTH; AND

CONDITIONS OF SCHOOLS, PLACES OF BUSINESS, AND PLACES OF
EMPLOYMENT IN THE COUNTY.

(B)  COMPLAINT.

EXCEPT IN BALTIMORE COUNTY, ON THE WRITTEN COMPLAINT OF
A PHYSICIAN OR OF AT LEAST 2 PERSONS WHO CLAIM TO BE
AFFECTED BY THE CONDITION, THE HEALTH OFFICER FOR THE COUNTY
WHERE THE CONDITION ALLEGEDLY EXISTS IMMEDIATELY SHALL
INVESTIGATE ANY COMPLAINT THAT ANY OF THE FOLLOWING IS IN A
CONDITION DANGEROUS TO HUMAN HEALTH:

(1)  ANY WATERCOURSE, WELL, SPRING, OPEN DITCH
GUTTER, CESSPOOL, DRAIN, OUTHOUSE, PIGPEN, OR OTHER PLACE.
