(1) ADOPT RULES AND REGULATIONS TO CARRY OUT THE
PROVISIONS OF THIS SUBTITLE;

(2) ESTABLISH A PROFICIENCY TESTING PROGRAM TO
TEST THE PERFORMANCE OF ANY WATER QUALITY LABORATORY; AND

(3) SET STANDARDS FOR:

(I) DEMONSTRATING SATISFACTORY PERFORMANCE
IN A PROFICIENCY TESTING PROGRAM; AND

(II) CONDUCTING THE PROGRAM.

(B) SECRETARY.

THE SECRETARY SHALL HAVE EACH WATER QUALITY LABORATORY
INSPECTED ANNUALLY.

REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 34A(b) and (d)(1).

The General Assembly may wish to consider
changing the term "annually" in subsection (b) of
this section to read, e.g., "periodically" (as in
35 Pa. Statutes Annotated § 2161) or "every three
years" (as in Calif. Health and Safety Code §
4025). The Department suggests this change
because the term "annually" could prevent this
State from granting reciprocity to out-of-state
laboratories that wish to perform water quality
tests in this State.

The only changes are in style.

PART II. CERTIFICATION.

9-1006. CERTIFICATION REQUIRED.

A WATER QUALITY LABORATORY SHALL BE CERTIFIED BY THE
DEPARTMENT BEFORE THE WATER QUALITY LABORATORY MAY BE
OPERATED IN THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 34A(c)(l).

The former reference to this section taking
effect after October 31, 1980 is deleted as
obsolete.
