(B) CERTIFICATION.

"CERTIFICATION" MEANS CERTIFICATION BY THE DEPARTMENT
UNDER THIS SUBTITLE.

REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 34A(a)(5).

On occasion in this subtitle, the term
"certified" is used to refer to a person who has
received certification under this subtitle and
the term "certify" is used to refer to the
process of issuing a certification under this
subtitle.

(C)  PERSON.

"PERSON" INCLUDES ANY STATE, COUNTY, MUNICIPAL
CORPORATION, FEDERAL AGENCY, OR SPECIAL TAXING AREA.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 34A(a)(2).

This subsection is intended to be read with the
definition of "person" in § 1-101 of this
article. Therefore, the former references to "an
individual, corporation, company, association,
partnership" and to "any other entity" are
deleted as unnecessary.

(D)  PUBLIC DRINKING WATER SYSTEM.

"PUBLIC DRINKING WATER SYSTEM" HAS THE MEANING STATED
IN THE FEDERAL SAFE DRINKING WATER ACT FOR "PUBLIC WATER
SYSTEM".

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the reference in
former Article 43, § 34A(a)(3) to the meaning of
"public drinking water system".

The term "federal Safe Drinking Water Act" is
substituted for "National Safe Drinking Water Act
of 1974" for accuracy. The new language properly
cites the short title of the federal act. See
Section 1 of Public Law 93-523.

The former language "as amended", which modified
the reference to the federal Safe Drinking Water
Act, is deleted as unnecessary in light of
Article 1, § 21 of the Code. As to the
