OFFICE OF THE FIRST MEMBER OF THE BOARD OF THE AUTHORITY
FROM THE INCOMING MUNICIPALITY. ARTICLES OF WITHDRAWAL AMD
ARTICLES OF JOINDER SHALL BE FILED WITH THE STATE DEPARTMENT
OF ASSESSMENTS AND TAXATION, WHICH SHALL RECEIVE THE
ARTICLES AND ENDORSE. ON THEM THE DATE AND TIME OF RECEIPT.
WHEN THE DEPARTMENT OF ASSESSMENTS AND TAXATION ISSUES A
CERTIFICATE OF APPROVAL, THE ARTICLES OF WITHDRAWAL OR
ARTICLES OF JOINDER SHALL BECOME EFFECTIVE, BE IN FULL FORCE
AND EFFECT, AND BE CONCLUSIVELY DEEMED TO HAVE BEEN LAWFULLY
AND PROPERLY ADOPTED.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 448.

In subsection (b) of this section, "State
Department of Assessments and Taxation" is
substituted for "State Tax Commission" in light
of Article 41, § 318 of the Code.

Also in subsection (b) of this section, the
former references to the State Department of
Assessments and Taxation reviewing and recording
the articles of withdrawal or articles of joinder
are deleted as unnecessary in light of CA §§
1-201 and 1-202.

The only other changes are in style.

9-905. POWERS OF AUTHORITY TO BE EXERCISED BY BOARD.

THE POWERS OF EACH AUTHORITY SHALL BE EXERCISED BY A
BOARD COMPOSED AS FOLLOWS:

(1) IF THE AUTHORITY IS INCORPORATED BY A SINGLE
MUNICIPALITY, THE BOARD SHALL BE COMPOSED OF THE MEMBERS OF
THE GOVERNING BODY OF THE MUNICIPALITY CREATING THE
AUTHORITY OR SHALL BE COMPOSED OF 5 CITIZENS OF THE
MUNICIPALITY, AS THE GOVERNING BODY OF THE MUNICIPALITY
SHALL DETERMINE. IF THE GOVERNING BODY OF THE MUNICIPALITY
CREATING THE AUTHORITY DETERMINES THAT THE BOARD SHALL BE
COMPOSED OF THE MEMBERS OF THAT GOVERNING BODY, THE TERMS OF
OFFICE OF THE MEMBERS OF THE BOARD SHALL COINCIDE WITH THEIR
TERMS OF OFFICE AS MEMBERS OF THE GOVERNING BODY AND ANY
MEMBER OF THE GOVERNING BODY SHALL AUTOMATICALLY BE A MEMBER
OF THE BOARD AND SHALL CEASE TO BE A MEMBER OF THE BOARD ON
CEASING TO BE A MEMBER OF THE GOVERNING BODY. IF THE
GOVERNING BODY OF THE MUNICIPALITY CREATING THE AUTHORITY
DETERMINES THAT THE BOARD SHALL CONSIST OF 5 CITIZENS, THE
GOVERNING BODY OF THE MUNICIPALITY SHALL APPOINT THE MEMBERS
OF THE BOARD, WHOSE TERMS OF OFFICE SHALL COMMENCE ON THE
DATE OF APPOINTMENT, AND 1 OF WHOM SHALL SERVE FOR 1 YEAR, 1
FOR 2 YEARS, 1 FOR 3 YEARS, 1 FOR 4 YEARS, AND 1 FOR 5 YEARS
FROM THE JANUARY 1 NEXT FOLLOWING THE DATE OF INCORPORATION.
THEREAFTER, THE GOVERNING BODY SHALL, AT A MEETING HELD NOT
LATER THAN 1 MONTH PRIOR TO JANUARY 1 IN EACH YEAR IN WHICH
