LAWS OF MARYLAND

Ch. 21

REVISOR'S NOTE: Subsection (a) of this section is new
language, derived without substantive change from
the second sentence of former Article 22, § 1,
except for the first clause of that sentence.

Subsection (b)(1) and (3) of this section is new
language derived without substantive change from
the third sentence of former Article 22, § 1, as
that sentence related to officers.

Subsection (b)(2) of this section is new language
added to clarify the manner of election for
officers of the Commission and their terms of
office.

In subsection (a)(2) and (3) of this section, the
phrase "head of the Pathology Department of the
School of Medicine" is substituted for
"professor of pathology" to clarify which of
several professors of pathology are members of
the Commission.

Defined terms: "Commission" § 5-301
"Department" § 1-101 "Secretary" § 1-101

5-304. MEETINGS; COMPENSATION.

(A)  MEETINGS.

THE COMMISSION SHALL DETERMINE THE TIMES AND PLACES OF

ITS MEETINGS.

(B)  COMPENSATION.

A MEMBER OF THE COMMISSION MAY NOT RECEIVE
COMPENSATION.

REVISOR'S NOTE: Subsection (a) of this section is new
language added for clarity.

Subsection (b) of this section is new language
derived without substantive change from the first
clause of the third sentence of former Article

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that there is no quorum provision. In the
absence of an express provision,, rule, or
regulation, case law indicates that a majority of
the members is a quorum. See Gemeny v. Prince
George's County, 264 Md. 85 (1972); Zeiler v.
Central Ry., 84 Md. 304 (1896); and Heiskell v.
Mayor of Baltimore, 65 Md. 125 (1886).
