PROPOSED PROJECT OR SERVICE SUBAREA SHALL HEAR THE APPEAL
FROM THE SECOND HEARING.

(S) UNANIMITY OF MEMBER COUNTIES REQUIRED.

AFTER AN APPEAL UNDER THIS SUBSECTION, THE PROPOSED
PROJECT OR SERVICE SUBAREA MAY NOT BE ESTABLISHED UNLESS THE
GOVERNING BODY OF EACH MEMBER COUNTY AFFIRMS THE PROPOSED
PROJECT OR SERVICE SUBAREA.

(T) DECISION FINAL.

THE DECISION OF THE GOVERNING BODIES OF THE MEMBER
COUNTIES IS FINAL.

REVISOR'S NOTE:. This section is new language derived
without substantive change from former Article
43, § 653 and the thirteenth sentence of §
652(b).

Throughout this section, the term "service
subarea" is new language added to clarify that
the terms "sanitary district", "service area",
and "service subareas" denote progressively
smaller jurisdictional concepts.

In subsection (a) of this section, the references
to a time after creation of a service area and to
"further surveys" are new language added to
emphasize the legislative intent that this
section applies to actions taken after the
creation of a service area. This legislative
intent is evident from the provision in the
thirteenth sentence of former Article 43, §
652(b), that notice under former Article 43, §
652 was not required for actions taken under
former Article 43, § 653, which now appears in
this section.

Subsection (k)(3) of this section is new language
added to emphasize the requirement, apparent from
the former reference to "objections stated in the
petition", that the petitioners state their
objections in the petition.
