(T) CREATION OF SERVICE AREA.
A SERVICE AREA IS CREATED WHEN THE REQUIREMENTS OF THIS
SECTION HAVE BEEN MET.
(U) TAXING DISTRICT.
EACH SERVICE AREA CREATED UNDER THIS SECTION IS A
SEPARATE TAXING DISTRICT.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first through
the twelfth sentences of former Article 43, §
652(b) and the seventh sentence of (d).
Throughout this section, former references such
as "constituted as a new sanitary district or
added to an existing sanitary district ... which
... is contiguous" are deleted as included in the
broader term "proposed service area", which,
depending on the circumstances, would be a new
service area or an existing service area together
with its proposed new territory.
In subsection (c)(1) of this section, "the lesser
of" is new language added to emphasize the
legislative intent, apparent from the legislative
history of the provision, that, if there are less
than 100 owners in a proposed service area,
petition by 25 percent of those owners would
require the sanitary commission to consider
designating the proposed service area under this
section. See the purpose paragraph to Ch. 847,
Acts of 1965.
In subsection (e) of this section, the former
reference to the cost and feasibility of
"providing such area with utilities or
facilities, whether water, sewer, solid waste
disposal or otherwise" is deleted as included in
the broader reference to "services that a
district can provide".
9-650. ADVANCES BY MEMBER COUNTIES FOR SERVICE AREAS.
(A) IN GENERAL.
IN ADDITION TO THE POWER TO MAKE ANY OTHER ADVANCES
UNDER THIS SUBTITLE, THE GOVERNING BODY OF A MEMBER COUNTY
MAY ADVANCE TO A DISTRICT THE FUNDS NECESSARY TO ORGANIZE
AND TO MEET THE PRELIMINARY EXPENSES OF A SERVICE AREA OR A
PROPOSED SERVICE AREA.
(B) REPAYMENT REQUIRED.
