HARRY HUGHES, Governor

2257

issuance of bonds to pay for solid waste disposal
systems and solid waste acceptance facilities.
However, that chapter did not amend former
Article 43, § 645(j) to include a reference to
costs incurred for solid waste disposal systems
or solid waste acceptance facilities.

In paragraph (l)(iv) of this subsection, the
former reference to "lands, properties, rights,
easements, franchises, and permits" is deleted as
included in the broader reference to an "interest
in real or personal property".

(D)  DISTRICT.

(1) "DISTRICT" MEANS AN ENTITY THAT IS CREATED
UNDER THIS SUBTITLE.

(2) "DISTRICT" INCLUDES A BOARD, BODY, OR
COMMISSION THAT ASSUMES THE PRINCIPAL FUNCTIONS OF A
DISTRICT THAT IS CREATED UNDER THIS SUBTITLE AND LATER
ABOLISHED.

REVISOR'S NOTE; This subsection is new language derived
without substantive change from former Article
43, § 645(a) -- except for the reference in that
subsection to "a body politic and corporate".

(E)  GOVERNING BODY.

"GOVERNING BODY" MEANS THE BODY OR BOARD THAT IS
AUTHORIZED TO ENACT ORDINANCES OR RESOLUTIONS FOR A COUNTY.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 645(d).

(F) IMPROVEMENT.

"IMPROVEMENT" MEANS ANY CONSTRUCTION, REPAIR,
REPLACEMENT, EXTENSION, OR BETTERMENT OF A PROJECT.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first clause
of former Article 43, § 645(i).

The defined term "project" is substituted for the
reference to "a water system or a sewerage
system" for clarity and to reflect that the
reference to "improvement" applies to a "solid
waste disposal system" and a "solid waste
acceptance facility".

(G) INDEPENDENT SYSTEM.
