DRINKING WATER REGULATIONS SHALL APPLY TO EVERY PUBLIC WATER
SYSTEM IN THIS STATE.

(B) EXCEPTIONS.

THE STATE PRIMARY DRINKING WATER REGULATIONS DO NOT
APPLY TO A PUBLIC WATER SYSTEM THAT:

(1) CONSISTS ONLY OF DISTRIBUTION AND STORAGE
FACILITIES, AND DOES NOT HAVE ANY COLLECTION AND TREATMENT
FACILITIES;

(2) OBTAINS ALL OF ITS WATER FROM, BUT IS NOT
OWNED OR OPERATED BY, A PUBLIC WATER SYSTEM TO WHICH THE
STATE PRIMARY DRINKING WATER REGULATIONS APPLY;

(3) DOES NOT SELL WATER TO ANY PERSON; AND

(4) IS NOT A CARRIER THAT CONVEYS PASSENGERS IN
INTERSTATE COMMERCE.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 386C(b).

In subsection (b) of this section, the word "and"
at the end of item (3) is new language added to
resolve an ambiguity in the former law. This
addition appears to reflect legislative intent.
See 42 U.S.C. § 300g and the legislative history
at 1974 U.S. Code Cong, and Administrative News
6454. This revision is called to the attention
of the General Assembly.

The only other changes are in style.

9-409. SAME -- VARIANCES AND EXEMPTIONS.

THE SECRETARY MAY AUTHORIZE VARIANCES OR EXEMPTIONS
FROM THE RULES AND REGULATIONS ISSUED IN ACCORDANCE WITH §
9-407 OF THIS SUBTITLE, UNDER CONDITIONS AND IN A MANNER
NECESSARY AND DESIRABLE. HOWEVER, THE VARIANCES OR
EXEMPTIONS ARE PERMITTED ONLY UNDER CONDITIONS AND IN A
MANNER THAT IS NOT LESS STRINGENT THAN THE CONDITIONS UNDER,
AND THE MANNER IN WHICH, VARIANCES AND EXEMPTIONS MAY BE
GRANTED UNDER THE FEDERAL ACT.
