REVISOR'S NOTE: This section is new language derived
without substantive change from the penalty
clauses in former Article 43, § 28(a) through

(g).

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that it may wish to consolidate items (1), (2),
(3), and (6) of this section and provide for a
uniform penalty of a fine not exceeding $500.

GENERAL REVISOR'S NOTE:

Former Article 43, § 14(b)(2), which authorized the
adoption of rules and regulations, is deleted as unnecessary
in light of the broad rulemaking power of the Secretary
under § 2-104(b) of this article.

Former Article 43, § 14(b)(3), which provided for the
Baltimore City vital records to be transferred to this
State, is deleted since the transfer has been effected.

Former Article 43, § 28A is deleted as unnecessary in
light of the severability provision of Article 1, § 23 of
the Code.

Former Article 43, § 37, which required the State Board
of Health to supervise birth and death records, is deleted
as unnecessary in light of §§ 4-203 and 4-204 of this
subtitle.

SUBTITLE 3. PERSONAL MEDICAL RECORDS.

4-301. DISCLOSURE OF MEDICAL RECORDS.

(A) AUTHORIZED DISCLOSURES.

ANY PROVIDER OF MEDICAL CARE WHO HAS CUSTODY OF MEDICAL
RECORDS MAY REVEAL SPECIFIC MEDICAL INFORMATION CONTAINED IN
THOSE RECORDS:

(1) TO THE INDIVIDUAL ON WHOM THE RECORD IS KEPT
OR THE INDIVIDUAL'S AGENT OR REPRESENTATIVE; OR
