2216                                   LAWS OF MARYLAND                                Ch. 240

INDUSTRIAL USER OF A PUBLICLY OWNED TREATMENT WORKS:

(1) TO KEEP RECORDS;

(2) TO MAKE REPORTS;

(3) TO INSTALL, CALIBRATE, USE, AND MAINTAIN
MONITORING EQUIPMENT OR METHODS, INCLUDING, WHERE
APPROPRIATE, BIOLOGICAL MONITORING METHODS;

(4) TO SAMPLE DISCHARGES IN ACCORDANCE WITH THE
METHODS, AT THE LOCATIONS, AT THE INTERVALS, AND IN THE
MANNER THE DEPARTMENT REQUIRES; AND

(5) TO PROVIDE TO THE DEPARTMENT ANY INFORMATION
THAT THE DEPARTMENT REASONABLY REQUIRES ABOUT:

(I) DISCHARGE OF POLLUTANTS INTO THE
WATERS OF THIS STATE; OR

(II) INTRODUCTION OF POLLUTANTS INTO
PUBLICLY OWNED TREATMENT WORKS.

REVISOR'S NOTE: This section formerly appeared as NR §
8-1413(h).

In item (1) of this section, "keep" is
substituted for "establish and maintain", for
simplicity.

In item (5) of this section, "to the Department"
is new language added for clarity.

9-334. COMPLAINT.

(A) ISSUANCE OF COMPLAINT.

THE DEPARTMENT SHALL ISSUE A WRITTEN COMPLAINT IF THE
DEPARTMENT HAS REASONABLE GROUNDS TO BELIEVE THAT THE PERSON
TO WHOM THE COMPLAINT IS DIRECTED HAS VIOLATED:

(1) THIS SUBTITLE;

(2) ANY RULE OR REGULATION ADOPTED UNDER THIS
SUBTITLE; OR

(3) ANY ORDER OR PERMIT ISSUED UNDER THIS
SUBTITLE.
