IN THE VOLUME OR CHARACTER OF POLLUTANTS BEING INTRODUCED
INTO THE TREATMENT WORKS.

(B) GRANT OF RIGHT OF ENTRY.

ISSUANCE OF A DISCHARGE PERMIT IS CONTINGENT ON THE
GRANT BY THE PERMIT HOLDER TO THE DEPARTMENT OF A RIGHT OF
ENTRY ON THE PERMIT SITE AT ANY REASONABLE TIME TO INSPECT
AND INVESTIGATE. FOR VIOLATION OR POTENTIAL VIOLATION OF ANY
CONDITION OF THE PERMIT.

REVISOR'S NOTE: Subsection (a)(1) of this section is
new language derived without substantive change
from former NR § 8-1413(f).

Subsection (a)(2) of this section formerly
appeared as NR § 8-1413(j).

Subsection (b) of this section formerly appeared
as the first sentence of NR § 8-1413(g).

The only changes are in style.

9-327. REFUSAL OF PERMIT.

THE DEPARTMENT MAY REFUSE TO ISSUE A DISCHARGE PERMIT
IF:

(1) THE PERMIT HOLDER FAILS OR REFUSES TO ALLOW
ANY REPRESENTATIVE OF THE DEPARTMENT TO INSPECT THE PROPOSED
PERMIT SITE; OR

(2) THE DEPARTMENT FINDS THAT ISSUANCE OF THE
PERMIT WOULD VIOLATE ANY FEDERAL LAW OR ANY RULE OR
REGULATION ADOPTED UNDER ANY FEDERAL LAW.

REVISOR'S NOTE: This section is new language derived
without substantive change from former NR §
8-1413(i) and the second sentence of (g).

In item (1) of this section, "or refuses" is new
language added for clarity and consistency with
other, similar provisions in this article.

Also in item (1) of this section, the former
reference to revoking a permit is deleted as
unnecessarily repetitive of former NR §
8-1413(1)(4) — which now appears in § 9-330 of
this subtitle.

9-328. TERM AND RENEWAL OF DISCHARGE PERMITS.

(A) TERM OF PERMIT.
